What happens when a child gets hurt and we don’t know how or who caused it? If a court is satisfied that a child has suffered an injury or injuries, the first question is whether they were caused deliberately or by accident.

What is Non-Accidental Injury?

A non-accidental injury means that a parent or carers actions or neglect has caused an injury to a child. This could include for example a broken bone, bruising, a skull fracture, bleeding on the brain or bleeding behind the eyes.

Sometimes if a child has suffered an injury and they need to see a GP or visit the hospital, the medical professionals could decide to inform social services. They will only do this if they have concerns about how the injury occurred. For example, they may be worried if no explanation has been given about how the injury was caused, or if the explanation given does not fit with how the injuries are presenting. These concerns could be raised by other people too, such as Teachers, Social Workers or members of the family if they are worried about an injury a child has experienced.

    What to expect

    Being accused of harming a child is a terrifying thought for any parent, but it can become a real and serious issue if their child has physical injuries that cannot be explained. In some cases parents can be accused of inflicting these injuries and have to defend themselves against these allegations in court. If this happens it is likely that the child will be removed from the home to live with relatives or to be put into care until the court proceedings are concluded.     I’ve been working with A&N Care Solicitors since I was in PLO. I was in an OK place, then an incident occurred in July 2014 which resulted in the local authority taking away my child in to care.
